Website Terms of Use

These terms and conditions of use (the “Terms of Use”) apply to the Roman Catholic Diocese of Port Louis (hereinafter “RCDPL”) website located at https://coupdepouceamoneglise.mu/ (hereinafter the “Website”). Please read the present Terms of Use carefully before using this Website. The Website is made available for your use only on the condition that you agree to the present Terms of Use. All references in the present Terms of Use to « you« , « your » or « User » refers to an individual who uses the Website.  By accessing and using the Website, you agree to these Terms of Use. If you do not agree to these Terms of Use, please do not access or use the Website.

RCDPL reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Website following the posting of changes will mean that you accept and agree to the changes and are bound by the updated Terms of Use. As long as you comply with these Terms of Use, RCDPL grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website. RCDPL also reserves the right to discontinue the service available on the Website at its sole discretion. By continuing to use the Website after the amended Terms of Use are published, you agree to be bound by such updated terms.

1. DEFINITIONS

1.1. “ Act” means the Public Collection Act of 1965, as amended from time to time.
1.2. “Autofinancement Project” means monetary contributions aimed at supporting the mission of RCDPL, which is committed to serving both Mauritian society and the Roman Catholic Church.
1.3. “Contributor(s)” means any individual or entity that makes a donation to RCDPL via the Website.
1.4. “Donation” means any voluntary financial contribution made by any individual or entity to support the Autofinancement Project of the RCDPL.
1.5. “Minimum Donation Amount” means the minimum amount that a Contributor may donate.
1.6. “MIPSIT Digital Ltd (“MIPS”)” means the service provider, facilitating technical and administrative interactions among banks, financial institutions, payment services providers, and payment gateways..

2. INTRODUCTION

2.1. RCDPL has the right to receive donations under the Act.
2.2. The Contributor agrees to support RCDPL’s Autofinancement Project by making a donation.
2.3. The Donation provided to RCDPL for its Autofinancement Project is as an irrevocable gift.
2.4. RCDPL undertakes to use the Donations, at its discretion, but in accordance with the Autofinancement Project.

3. DONATIONS

3.1. Payment methods
3.1.1. The Contributor shall make the Donation, on the Website, by using one of the following payment method:
3.1.1.1. Credit card; or
3.1.1.2. Debit card; or
3.1.1.3. Bank transfer; or
3.1.1.4. Standing order; or
3.1.1.5. Mobile payment (including, but not limited to, Juice by Mauritius Commercial Bank Ltd, Myt Money by Mauritius Telecom, Blink by Emtel, POP by Bank One)
3.2. Upon choosing the payment method, the processing of the Donation will be facilitated by the payment services provider, MIPS. By confirming your intention to proceed with a donation on the Website, you grant authorisation to MIPS to carry out the payment processing of the Donation using your selected payment method.

4. REGULAR DONATION

4.1. You have the option to set up your donations to RCDPL for automatic initiation at a predetermined amount and scheduled payment frequency. You can choose to make donations either on a monthly or annual basis, (the « Regular Donation »).
4.2. Upon expressing your intent to proceed with a Regular Donation, you hereby grant authorization to MIPS for the processing of payment for the Regular Donation through your designated payment method at the selected scheduled payment frequency.
4.3. The continuity of your Regular Donation shall persist until you undertake cancellation in conformity with Clause 6 or until RCDPL, at its sole discretion, opts to cease the acceptance of such Donations through your designated payment method.

5. MINIMUM DONATION AMOUNT

5.1. To ensure the sustainability and effectiveness of RCDPL’s Autofinancement Project, a Minimum Donation Amount of one hundred rupees (Rs 100) is required for all Donations.

6. CANCELLATION

6.1. Subject to clause 6.3, you may cancel your Regular Donation, by clicking on the “Cancellation link” found in the email sent to you when subscribing to the Regular Donation option.

6.3. In order to proceed with cancellation of your Regular Donation, you are required to provide the following notices:
6.3.1. One (1) months’ notice to cancel an annual donation;
6.3.2. Fourteen (14) days’ notice to cancel a monthly donation.

7. ELIGIBILITY

7.1. RCDPL shall accept Donations from individuals, as well as legal entities, from Mauritius and abroad.
7.2. In any event, a Contributor, who is an individual, shall be at least eighteen (18) years old in order to proceed with a Donation.

8. UNAUTHORISED USE

8.1. RCDPL shall not be responsible for any fraudulent utilisation of the payment method you have chosen. In the event that you become aware of any fraudulent activity involving your selected payment method or if your card used for Donations is lost or stolen, you undertake to promptly inform RCDPL. This will enable us to proceed with the cancellation of the Regular Donation, if subscribed to.

9. PERSONAL INFORMATION

9.1. Before we can process your Donation, you are required to provide us with the following information:
9.1.1. Your name, email address, and phone number; and
9.1.2. details your banking details and/or card details, depending on the payment method selected (the “Payment Details”).
9.2. We will use these above information to process your Donation. It is your responsibility to ensure you have provided us with the correct information.
9.3. When you submit your Payment Details, these will be transferred to MIPS and your payment shall be securely processed by them.
9.4. The RCDPL is committed to protecting the privacy of its Contributors. Hence, we undertake not to share your personal details with any other third party other than as set out in our Privacy Policy published on our website https://coupdepouceamoneglise.mu/privacy-policy/.
9.5. Our Privacy Policy forms part of these Terms of Use and by agreeing to these Terms of Use you are also agreeing to our Privacy Policy.

10. LIMITATION OF LIABILITY

10.1. RCDPL shall not be liable to you or any third person for any direct, indirect, consequential, special, incidental or punitive damages arising from your use of the Website.

11. INDEMNITY

11.1. You agree to indemnify and hold RCDPL, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any damage, loss, liability, claims or expenses (including attorneys’ fees), made against you by any third party due to or arising out of or in connection with your use of the Website.

12. JURISDICTION AND GOVERNING LAW

12.1. This Terms of Use shall be construed, interpreted and applied in accordance with, and shall be governed by the laws applicable in the Republic of Mauritius.
12.2. The formation, interpretation and performance of the Terms of Use shall be governed by the laws of Mauritius. Any disputes, controversy or claims arising out of or relating to these Terms of Use, or the breach, or invalidity thereof shall be resolved by an appropriate court of law in Mauritius. The Parties hereto expressly agree to the jurisdiction and venue of such courts in Mauritius.
